SERVICE TERMS & CONDITIONS

These Terms & Conditions apply to services provided by Hush & Bloom Limited (“Hush & Bloom”, “we”, “our” or “us”).
By booking or purchasing a service, completing a client intake form, or engaging Hush & Bloom for sleep consulting services, you agree to these Terms & Conditions.
1. Our Services
Hush & Bloom provides personalised, evidence-informed infant and child sleep consulting, education and support.
Services may include sleep assessments, personalised sleep plans, consultations, sleep logs, written resources, and ongoing support by phone, video, text or voice message, depending on the package purchased.
The specific inclusions and duration of your service will be confirmed at the time of booking.
2. Intellectual Property & Personal Use
All personalised sleep plans, biological roadmaps, written recommendations, educational materials, digital guides, templates, resources, graphics, documents and other content created or provided by Hush & Bloom remain the intellectual property of Hush & Bloom Limited unless otherwise stated.
Once payment has been made, you are granted a limited, non-transferable, non-exclusive licence to use these materials for your personal, private and non-commercial family use.
You must not, without prior written permission:
Copy, reproduce, distribute, publish or commercially exploit Hush & Bloom materials.
Share personalised sleep plans, guides or resources publicly or with third parties, including online forums, parenting groups or social media.
Resell, licence, modify or create derivative works from Hush & Bloom materials.
Use Hush & Bloom materials for professional practice, commercial purposes, or AI training or content generation.
3. Client Information & Partnership
Personalised recommendations are based on the information you provide to Hush & Bloom.
You agree to provide accurate and relevant information about your child's sleep, health, development, feeding, environment and family circumstances, and to let Hush & Bloom know if circumstances materially change during your support period.
Sleep is influenced by many factors, including development, temperament, health, environment and family circumstances. While Hush & Bloom provides personalised analysis, recommendations and support, outcomes depend on a range of factors and cannot be guaranteed.
No specific sleep outcome, timeframe or result is promised.
4. Medical & Health Disclaimer
Hush & Bloom provides sleep consulting and education and does not provide medical diagnosis, treatment or healthcare services.
Georgie Hay is a Certified Infant and Child Sleep Consultant with additional training in Neuro-Protective Sleep Consulting. She is not a medical practitioner, paediatrician, psychologist or registered healthcare provider.
Sleep recommendations are not intended to replace advice from your GP, paediatrician, Plunket nurse, lactation consultant or other qualified healthcare professional.
If your child has a medical condition or you have concerns about their health, development, feeding, growth, breathing, reflux, allergies or general wellbeing, you should seek appropriate medical advice.
Hush & Bloom may recommend that you seek medical or other professional support where appropriate.
5. Safe Sleep
Hush & Bloom supports current evidence-based safe sleep recommendations.
Parents and caregivers remain responsible for ensuring their child's sleep environment and practices are appropriate and comply with current recommendations from relevant health authorities.
Hush & Bloom does not supervise your child's sleep environment and cannot guarantee the safety of sleep arrangements implemented by a family.
6. Fees & Payment
Fees for services are provided at the time of booking or confirmed before services commence.
Payment is required by the due date stated on your invoice. A booking may not be confirmed and services may not commence until payment has been received, unless otherwise agreed in writing.
7. Support Period & Communication
Your support period begins on the mutually agreed start date and continues for the duration specified in your package.
Support is provided within the communication methods and hours outlined for your package. Hush & Bloom is not an emergency or on-call service and cannot guarantee an immediate response.
If you have an urgent medical or safety concern, contact the appropriate medical or emergency service rather than relying on Hush & Bloom support.
8. Cancellations, Rescheduling & Pausing Support
Support packages are designed to run consecutively for the agreed support period.
Requests to reschedule, pause or extend support due to illness, family emergencies, travel or other unforeseen circumstances may be considered at the discretion of Hush & Bloom.
Where possible, reasonable notice should be provided for cancellations or requests to reschedule appointments.
9. Refunds
Because Hush & Bloom services involve personalised assessment, preparation and professional time, fees become non-refundable once work has commenced on a personalised sleep assessment or plan.
Where a personalised sleep plan, roadmap or written recommendations have been delivered, the service is considered to have been provided and no refund will be available for that component.
Nothing in these Terms & Conditions limits or excludes any rights you may have under the Consumer Guarantees Act 1993 or other applicable New Zealand law.
10. Privacy & Confidentiality
Hush & Bloom respects the privacy and confidentiality of client information.
Personal information, intake forms, sleep logs, communications and client documentation will be handled in accordance with applicable New Zealand privacy law and Hush & Bloom's Privacy Policy.
Information will not be disclosed to third parties except where you have provided consent, where disclosure is necessary to provide a service, or where disclosure is required or permitted by law.
11. Limitation of Liability
To the maximum extent permitted by New Zealand law, Hush & Bloom will not be liable for indirect or consequential loss arising from the use of its services, recommendations, resources or educational materials.
Hush & Bloom does not guarantee any particular sleep outcome, duration of improvement or timeframe for change.
Nothing in these Terms & Conditions excludes or limits any liability or consumer rights that cannot lawfully be excluded or limited under New Zealand law.
To the extent permitted by law, Hush & Bloom's liability in relation to a service will be limited to the amount paid for that service.
12. Ending or Refusing Services
Hush & Bloom reserves the right to decline or discontinue services where there is a reasonable basis to do so, including where the service is no longer appropriate, information provided is materially inaccurate, communication becomes inappropriate or abusive, or the service falls outside the scope of sleep consulting.
Where appropriate, Hush & Bloom will provide reasonable notice and may recommend an alternative professional or service.
13. Governing Law
These Terms & Conditions are governed by the laws of New Zealand.
Any dispute will be dealt with in accordance with applicable New Zealand law and the jurisdiction of the New Zealand courts.
14. Changes to These Terms
Hush & Bloom may update these Terms & Conditions from time to time. The version applicable to your service will be the version in effect when you make your booking, unless otherwise required by law.
